The First-tier Tribunal (Charity)
The First–tier Tribunal (Charity) can:–
- Hear appeals against the decisions of the Charity Commission (the Commission)
- Hear applications for review of decisions of the Charity Commission
- Consider references from the Attorney General or the Charity Commission on points of law
The First–tier Tribunal (Charity) only has jurisdiction in respect of certain Charity Commission decisions made on or after the 18th March 2008. The commencement order can be viewed here. The decisions which can be challenged are set out in a table (Annex A) in schedule 1C to the Charities Act 1993.
The Charity Commission is established by law as the regulator and registrar of charities in England and Wales.

If you are not satisfied with the Commission's decision you may be able to appeal or make an application for review to the Tribunal. The table schedule 1C of the Charities Act 1993 (as amended by the Charities Act 2006) sets out for each type of decision who is eligible to request an appeal or apply for a review.
